Many buyers believe that once they’ve chosen a property and agreed on the price, the hardest part is over.
They expect that from that moment on, it’s just a matter of waiting for the notary appointment, signing a couple of papers, arranging a transfer and booking flights. But in reality, the most decisive part of the entire purchase does not happen during viewings, nor during negotiations, nor in the moment of saying yes. It happens between your “yes” and the signature at the notary.

It is in this period that we find out whether you are buying a home or buying a problem. This is when we discover whether the property can legally do what you think it can do: whether it is approved for residential use, whether you may live there permanently, whether renting is legally allowed, whether it is free of debts, claims, encumbrances or inheritance disputes, whether it legally exists exactly as it has been built, whether the square meters you see match those registered, and whether there are any unresolved building infractions or pending municipal issues. None of this appears in the photos.

This is when the documents come out that you never see during a viewing: the Nota Simple, Catastro records, License of Occupation, Energy Certificate, debt clearance certificates, mortgage status, technical inspection reports, Final de Obra, Seguro Decenal, and if there have been renovations, whether everything was declared and legalized. And that’s when you discover something unexpected: some homes are beautiful — but legally unusable.

It is also at this moment that the bank does not only evaluate you, but the property itself. Because for a mortgage to be approved, it is not enough that you can afford it. The property must be mortgageable, legally compliant, properly registered and suitable for habitation. Otherwise, even the strongest financial profile is not enough. And that is when buyers begin to understand: you are not just buying what you saw. You are also buying everything you haven’t seen yet — the legal truth behind the property.

That’s why this phase is not waiting time. It is the phase when the property stops selling and starts proving itself. The reservation or arras contract is drafted here. But an arras contract is not just the confirmation of a purchase. It is also your protection — the legal right to walk away if something is not as it should be. What if hidden debts appear? What if the property never had a habitation license? What if part of it was built without permission? What if it turns out to be legally classified as a touristic unit?

And that is where you see the real difference: between an agent who shows properties and an agent who protects buyers. Because after choosing does not come waiting. After choosing comes protecting. This is the moment when your dream can become your home — or your biggest mistake. This is the moment when the property stops smiling in photos and begins speaking with documents. And documents don’t lie.

There are properties that look perfect — until you ask about their past. Homes with sea views but no habitation license. Houses that look luxurious but carry debts from previous owners. Apartments that are sold as residential but officially registered as tourist units. Properties you can buy — but cannot legally live in. Nobody tells you this during the viewing. Because during the viewing, you’re not buying a property. You’re buying an idea.

But from the moment you say “yes”, it is no longer about falling in love. It is about preventing disappointment. And then, you understand something essential. A property should not only be beautiful for you. It must also be legally ready for you. It must have residential rights, legal security, fiscal clearance, mortgage approval — and a future.

That is the difference between finding and buying.
